Terms of Service
Plain-English terms for using datafairy — what the service is, what we promise, and what we ask of you.
The agreement
These terms are an agreement between you and datafairy, inc. ("datafairy", "we", "us") covering your use of the datafairy website, app (app.datafairy.ai), Chrome extension, and related services (together, "the service"). By creating an account or using the service, you accept these terms. If you're using datafairy on behalf of a company, you're accepting for that company and you confirm you're authorized to do so.
Our Privacy Policy explains what data we collect and how we handle it. It's part of the deal too.
What the service is
datafairy is a performance-marketing operator. It has two capabilities:
- Signal — auditing and fixing the conversion-tracking foundation on your site and in your connected marketing platforms (analytics tags, tag-manager configuration, conversion tracking, ad-platform measurement).
- Spend — running and optimizing advertising on top of that foundation, within budget caps and goals you set.
Two operating rules are built into how the service works, and these terms reflect them:
- Measurement changes are staged, not published. When datafairy proposes changes to your analytics or tag-manager setup, it stages them for your review. You approve and publish them — datafairy does not push measurement changes live on your behalf. That means you're the final check on any change before it affects your live site or data.
- Ad spend runs inside caps you set. Where the service manages advertising, it acts within the budget ceiling and goal bounds you configure, with an audit log. You own the ceiling and the goal; the service acts inside them.
Your account and responsibilities
- You need a Google account to sign in. Keep access to your account secure — actions taken through your account are yours.
- Only connect websites, analytics properties, tag-manager containers, and ad accounts that you own or are authorized to manage.
- Review what you approve. Because you're the one publishing staged measurement changes and setting spend caps, you're responsible for the changes you approve and the budgets you configure.
- You're responsible for complying with the terms of the platforms you connect (Google Analytics, Google Tag Manager, Google Ads, and others) and with the laws that apply to your marketing — including consent and privacy obligations to your own site visitors.
Acceptable use
Don't use the service to:
- scan, audit, or modify sites or accounts you don't own or aren't authorized to manage;
- probe, disrupt, or overload the service, or attempt to access other customers' data;
- resell or white-label the service without a written agreement with us;
- violate any ad platform's policies, or any applicable law, through configurations or campaigns you run with the service.
We can suspend or terminate accounts that violate these rules.
Your data and platform access
You grant datafairy the access it needs to do its job — reading configuration from platforms you explicitly connect, and (when you use apply features) writing the staged changes you approve. The scope of what we collect, store, and never touch is defined in the Privacy Policy. You can disconnect a platform or delete your account and its data at any time from the app.
Your data stays yours. We don't sell it, and we don't use your connected-account data for anything other than providing the service to you.
Fees
During early access, the service is offered free or at the pricing shown in the app at signup. When paid plans launch, pricing and billing terms will be presented before you're charged anything — no silent conversions from free to paid. Paid-plan specifics (billing cycles, refunds, plan changes) will be added to these terms when billing exists.
Intellectual property
We own the service — the software, the site, the brand. You own your data and your sites. Reports, findings, and recommendations the service produces for you are yours to use for your business.
Service availability — no warranty
datafairy is provided "as is" and "as available." We work hard to make it accurate and reliable, but we don't warrant that the service will be uninterrupted or error-free, that every finding is correct, or that any particular marketing outcome will result. Marketing measurement involves third-party platforms that change under everyone's feet; part of the service's job is catching that, but we can't guarantee it catches everything.
To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law: datafairy is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service. Our total liability for any claim relating to the service is capped at the greater of (a) the amount you paid us in the twelve months before the claim, or (b) US $100.
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
Termination
You can stop using the service and delete your account at any time — account deletion removes your stored data per the Privacy Policy. We can suspend or terminate your access if you materially violate these terms or if we discontinue the service; if we discontinue it, we'll give reasonable notice. Sections that by their nature should survive (intellectual property, no-warranty, limitation of liability, governing law) survive termination.
Governing law
These terms are governed by the laws of the jurisdiction where datafairy, inc. is established, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction over disputes relating to these terms.
Changes to these terms
If we make material changes, we'll update the "last updated" date at the top of this page, and for significant changes we'll notify you in the app or by email. Continued use of the service after changes take effect constitutes acceptance.
